The government has notified Negotiable Instruments (Amendments) Act 2015 which has allowed complainants to file the complaint in the city where he is based or where the cheque has been deposited. This amendment was passed by parliament in its winter session concluded in December 2015. Earlier such cases had to be filed by the complainants in the city, where branch of the bank exists of which cheque was issued by the issuer. In such cases, recipients of cheque located out station will have to travel to the city from where issued for fighting such case of cheque bouncing.
Now, with this amendment, it would be easier for the recipients of cheque to file such cases in the city, where he is based or in the city where he deposited the cheque for collection. The position because reverse for the issuer as he will have to travel to the city of recipient of cheque to fight cases of cheque bouncing .
The cheque issuing person or organization will have to be very careful in issuing cheque as bouncing of such cheques would create lot of problems to the issuer.
Through this amendment, the large number of pending cases of cheques bouncing would come down and recepients of cheque would be in a comfortable position . It would be a great relief to courts to reduce pending cases as number of pending cases in courts are fast increasing.
